Call for Comments: PCC Draft Guidelines for the Motu Proprio Review of Mergers and Acquisitions in Digital Markets
The Philippine Competition Commission (PCC), pursuant to its market surveillance function, is drafting the Guidelines for the Motu Proprio Review of Mergers and Acquisitions in Digital Markets.
This draft aims to guide digital companies to consult with the competition authority on whether a particular transaction might be harmful to competition. The combination of two or more indicators will be considered red flags, which, consequently, would potentially trigger a motu proprio review by the PCC.
In view of this, the PCC-Mergers and Acquisitions Office (MAO) invites stakeholders to submit their inputs, comments, and suggestions on the proposed guidelines.
You may send your feedback via e-mail at mergers@phcc.gov.ph until 15 May 2023.
